' XLVIII. And whereas by an Adt made in the tenth Year of the Reign of her late Majefty Queen 10 Ann. c. 19. Anne, for laying feveral Duties upon all Soap and Pa per made in Great Britain, and for other Purpofes ( ' cc - »7°" therein mentioned, it is provided, That Cards and Dice may be exported (free of the Stamp-Duties)^. e ^?p' Bond being entred into to her Majefty, her Heirs or Succeflbrs, with fufficient Surety or Sureties, in a Pe- fecutions upon nal Sum of double the Duties on fuch Cards or Dice, with Condition for exporting the fame into fome Bonds for ex- Part or Port beyond the Seas, within a Time to be limited in fuch Bond ; and that the fame, or any of porting Cards them fhall not be relanded in any Part of Great Britain ; and fuch Bonds are to be left in the Hands of™ li D,ce - the Commii'fioncrs for the Stamp-duties ; which Provifion was intended for encouraging the Exportation ^^'"/"V^f r " of Cards and Dice into foreign Parts, but hath been found to be a great Difcourageme-nt thereof, in re-gcvo.r. c. it. gard fuch Bonds do or may lie out againft the Parties bound therein, although the Conditions thereof n Cm. 1. c. 8. are or fhall have been performed ; and in regard fome of the Obligors in fuch Bonds have been profecuted ! - c ">' '• "• 33- thereupon feveral Years after the Dates thereof, and are or may be liable to the Penalties, although no 'i 7 " 1 z- c ~ S 2 - Fraud or Relanding be proved againft them, for that the Proof is on their Part, and the Perfons ufually Z qGb>.z'. c. z ' bound in fuch Bonds as Sureties for the Makers or Sellers of fuch Cards and Dice exported, are tholes? 13. ^oGn. who actually export the fame, and upon Account of fuch Suretyfhip cannot be legal Witneflcs for the z- c. 19. 32 , Principals in fuch Bonds, and it is im practicable to bring living Witneftes, or fuch fufficient Proof as G «- 2 - c - 35- the Law at prefent requires, from the Eaji and IVrJl Indies, and other foreign Parts to which Cards and Dice are commonly exported, to prove the Landings and Confumptions thereof in fuch foreign Parts : And whereas great Quantities of Cards and Dice exported are often con fumed in long Voyages at Sea, and there is no Provilion in the faid Ail for profecuting fuch Bonds in any limited Time, or for any 10 Ann. c, 19. Difcharge thereof, and it is reafonable to give Relief in the Premiffes :' Be it enacted by the Authority aforefaid, That as to fuch of the faid Bonds as have been entred into at any Time or Times before the fixth Day of April one thoufand feven hundred and nineteen, and are now remaining in the Hands of the Commiflioners for the Stamp-duties, or any of his Majefty's Officers, in cafe there fhall be no Profecution for fome Breach or Non-performance of the refpeftive Conditions thereof, before the fixth Day of April one thoufand feven hundred and twenty-one, or if upon fuch Profecution, Proof be not made of fome Fraud in Breach or Non-performance of fuch Conditions, and Judgment thereupon obtained for his Ma- jefty, before the fixth Day of April one thoufand {even hundred and twenty-two, then fuch of the faid Bonds fo already entred into, fhall (for want of fuch Proof or Judgment) be void ; and that all Profecu- jtions now depending upon any of the faid Bonds, which have not been commenced within two Years af- iter the Date thereof, and where Proof hath not been made, or fhall not be made, before the fixth Day of Farther Pnmff- 1 April one thoufand feven hundred and twenty, of fome Fraud in Breach or Non-performance of the Con- 3 " s concerning s.
