C. 20. 191 from and after the firft Day of September one thoufand feven hundred and thirty-five, it fhall and may be lawful for any of his Majefty's Subjects in any Ship or Veffel built in Great Britain, or belonging to any of his Majefty's Subjects redding in Great Britain, and navigated according to Law, that (hall clear outwards in any Port of Great Britain for the Province of Georgia in America, to (hip or load Rice in the faid Province, and to carry the fame directly to any Port Southward of Cape Finifterre, without carrying the fame to any other of his Majefty's Plantations in America, or to Great Britain, under the like En- tries, Securities, Redactions, Regulations, Limitations, Duties, Penalties and Forfeitures, as are par- ticularly defcribed, appointed, limited, or enacted for that Purpofe, in and by the faid Act of the third Year of the Reign of his prefent Majefty, intituled, An Ail for granting Liberty to carry Rice from bis Majefty's Province of Carolina in America, direclly to any Part of Europe, Southward of Cape Fini- fterre, in Ships built in and belonging to Great Britain, and navigated according to Law. ' effectual the faid Act : And whereas the Provifions made by the faid Acts for punifhing fuch Of- ' fenders, have by Experience been found to be infufficient :' Now for rendring the faid Acts more ef- fectual, be ■ it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That if any Perfon or Perfons whatfoever, after the fifteenth Day of May in the After 15 May, Year of our Lord one thoufand feven hundred and thirty-five, fhall, either by Day or Night, wilfully maiicioufwde- or malicioufly pull down, pluck up, throw down, level, or otherwise deftroy any Turnpike-Gate or ftroying i um- Turnpike-Gates, or any Poft or Pofts, Rail or Rails, Wall or Walls, or any Chain, Bar, or other Fence P' kes > &c - or Fences belonging to any fuch Turnpike-Gate or Turnpike-Gates, or any other Chain, Bar, or Fence of any Kind whatloever, fet up or erected, or hereafter to be fet up or erected, to prevent Paffengers from paffing by without paying any Toll, laid and directed to be paid by any Act or Acts of Parliament already made, or hereafter to be made > for that Purpofe, or any Houfe or Houfes erected or to be erected for the Ufe of any fuch Turnpike-Gate or Turnpike-Gates, or any other Fence or Fences, or any Lock, Lodes or Sluice, Flood-gate, or other Works on any navigable River erected or to be eerected by Authority of byTa" lament* Parliament ; or forcibly refcue any Perfon or Perfons being lawfully in Cuftody of any Officer or other or refcu'ing 6 " ' Perfon, for any of the Offences before-mentioned ; that then and in any of the faid Cafes, every Perfon Perfons in fo offending, being thereof lawfully convicted, fhall be adjudged guilty of Felony, and fhall fuffer Death £"h o&ences as in Cafes of Felony, without Benefit of Clergy. to fuffer Death. And be it further enacted, That if any Perfon or Perfons after the faid fifteenth Day of May fhall a Month's wilfully and malicioufly draw or pluck up any Flood-gate or Flood-gates, fixed or made in any Wear or imprisonment Wears, Lock or Locks, erected or made, or hereafter to be erected or made, by Authority of Parlia- ^" win 1C1 ° US ment, in or upon any navigable River for preferving the Navigation thereof ; all and every fuch Perfon Fiood-gates,&c. or Perfons fo offending, being thereof lawfully convicted upon the Oath of one or more credible Witnefs or Witneffes before two or more Juftice or Juftices of the Peace for the County, Riding or Divifion where any fuch Offence or Offences fhall be committed, or of the adjacent County, Riding or Divifion, (hall be fent to the Houfe of Correction, there to continue and be kept to hard Labour for the Space of one Month. III. And for the better and more impartial Trial of any Indictment which fhall be found, com- menced and profecuted, for the Offences committed againft this Act, Be it enacted by the Authority aforefaid, That every Offence aforefaid that fhall be done or committed contrary to this Act, fhall and Offences may may be enquired of, examined, tried and determined in any adjacent County within that Part of afiaeenV^ouni. the Kingdom of .Great Britain called England, in fuch Manner and Form as if the Fact had been ty. therein committed.
