Yf T els "If t< n be ***' An< ' *" or f ' ie better collecting the faid Money herein before directed to be paid for the charitablg Payment of the and ot, '. er P ublick - Ufes aforefaid, Be it enacted, That the faid Conful or other Perfon or Perfons appoint- Duties be made. ed by him, in the faid Port of Leghorn, (hall, and they are hereby reflectively authorized and required to detain the Clearances Outward of all Britijh or Irijh Ships and Veffels, and not give or deliver any Dif- patch or Bill of Health for any fuch Ship or Veffel, until Payment be made as atorefaid ; and in cafe the M after or Commander of fuch Ship or Veffel, in order to avoid the Payment of the faid Monies, fhall at any Time think, proper to depart without his faid Clearances Outward, then and in fuch Cafe the Conful fhall, upon the Return of the faid Mafter or Commander to any Port of his Majefty's Dominions, have a juft Action at Law againft him for all the Money which by virtue of this Act ought to have been paid. IV. And be it further enacted, That all Monies to be railed or received as afonfaid, (hall be applied in the Manner hereafter mentioned ; that is to fay, To the Succour and Rel'ef of Mariners Ship- wrecked and taken in War, and other diftreffed Perfons his Majefty's Subjects, and to Rich other cha- ritable and publick. Ufes as (hall from time to time be appointed by the Conful for the time being. with the Majority of the Britijh Merchants and Factors refiding at the faid Port of Leghorn, V. And be it enacted by the Authority aforefaid, That the Conful for the time being, appointed for ings^f tteMe'r- his Ma J e %'s Subjetfs trading to the Port of Leghorn, (hall from time to time, as he fhall fee Occa- chants and Fael uon f° r effecting the Purpofes of this Act, call and fummon a general Meeting; of the BritiJIj Merchants and Factors refiding at the faid Port ; and he is hereby obliged and required from time to time to call and fummon general Meetings or Affemblies as often as he fhall be defired, by Writing under the Hands of any five or more of the Britijh Merchants or Factors aforefaid ; and the Majority at fuch Meetings or Affemblies fhall from time to time order and determine all Matters and Things relating to the Premiffes. VI. And be it enacted by the Authority aforefaid, That this Act fhall be efteemed and taken in all Courts of Juftice and elfewhere to be a publick Act, and fhall be taken Notice of as fuch, without fpecially pleading the fame ; and if any Action fhall be brought, or Suit commenced, againft any Perfon or Perfons for any thing done in purfuance of this Act, or in relation to the Premiffes, the Defendant or Defendants in fuch Action may plead the General Iffue, and give this Act and the Special Matter in Evidence ,at any Trial to be had thereupon, and that the fame was done in purfuance and by the Au- thority of the laid Act ; and if the fame fhall appear to have been fo done, then the Jury fhall find for the Defendant or Defendants ; or if the Plaintiff or Plaintiffs fhall become nonfuited, or fuffer a Dif- . continuance of his, her or their Action or Actions, or if a Verdict fhall pafs againft the Plaintiff or Plaintiffs, or if upon Demurrer Judgment fhall be given againft the Plaintiff or Plaintiffs, the De- fendant or Defendants fhall have full Cofts, and fhall have fuch Remedy for the fame as any Defendant or Defendants hath or have for Cofts in other Cafes by Law. CAP. XV. An Aft to enable the prefent and future Proprietors and Inhabitants of the Houfes in Red Lion Square, in the County of Middlefex, to make a Rate on themfelves, for raifing Mo- ney fufficient to inclofe, pave, watch, clean and adorn the faid Square. ' T H E R E A S the Square called Red Lion Square, in the Parifh of Saint George the Martyr, in the •' VV County of Middlefex, hath for fome Time paft lain in great Diforder, and the Pales which inclofe

' nefs of all Kinds, and an Encouragement to common Beggars, Vagabonds and other diforderly Perfons ' to refort thither for the Exercife of their idle Diverfions and other unwarrantable Purpofes : To prevent ' all which Mifchiefs, and to the end the faid Square may be kept clean and in good Order, the Owners, ' Proprietors and Inhabitants thereof, are defirous that the faid Square may be inclofed, or otherwife ' made commodious, paved, watched and properly adorned, and kept in good Repair for the future, ■ ' and are willing that an adequate Contribution may for that Purpofe be raifed by and amongft themfelves ;' Wherefore the faid Proprietors and Inhabitants moft humbly befeech Your moft Excellent Majefty, that it may be enacted, csV. " Proprietors to meet on 15 July, in Grey's Inn, to choofe Truftees, who are to direct the adorning of the " Square. 205. Penalty on Perfons annoying the Square. Offender to be fent to the Houfe of Correc- " tion till he removes fuch Nufanee. Perfons gaming in or breaking the Fences of the Square, (hall for- " feit 405. or be fent to the Houfe of Correction for 1 Month. Truftees impowered to affefs is. 6d. " in the Pound on the Inhabitants, according to the Land-tax Affeffment for 1736. After 24 June 1737, " Owners to pay for untenanted Houfes, &c. Perfons refufing to pay what they are rated at, their Goods " maybe diftrained, and if not replevied in 5 Days, be appraifed and fold. After 7.$. June 1737, the " Square, &c. to be deemed a dift'inct Ward, and not liable to Scavenger's Rate, &c. and from that •" Tame St. Andrew's Parifh Holborn, difcharged from cleaning it, &c. Truftees may grant Annuities " on 1000/. for 32 Years, after the Rate of 61. per Cent, per Ann. and for one Life at the Rate of 1 " 8/. per Cent, per Ann.
