And be it futher enacted by the Authority aforefaid, That fo much of the before recited Act palled in the fourteenth Year of the Reign of Queen Elizabeth, as relates to the Method of taxing Parilhes for the Relief of Prifoners; and fo much of the faid Act of the forty-third Year of the fame Reign, as relates to the Method of raifing Money for the King's Bench and Marjhalfea Prifons, Hofpi- tal and Alms-houfes ; and fo much of the faid Act of the nineteenth Year of the Reign of King Charles the Second, as relates to the Method of rating Parifhes for providing Materials for the fetting poor Prifoners on work, (hall be repealed, and be abfolutely null and void. XXIII. Provided neverthelefs, That fuch Sums as have been annually paid to the King's Bench and Marjhdlfed Prifons, fhall be paid out of the Monies arifing by virtue of this Act, at fuch Times, and in fuch Manner, as is prefcribed in and by an Act pafTed in the eleventh Year of the Reign of his prefent Majefty, intituled, An Aft for the more effectual Jawing the Payments of certain Sums of' Money, direfled by an Aft made in the forty-third Year of the Reign of ghieen Elizabeth, intituled, An Act for the Relief of the Poor, to Le paid by the refpedtive Treafurers of every Connty of England and Wales, for the Relief of the poor Prifoners of the King's Bench and Marjhalfea Prifons ; and fuch Money as mail be judged neceffary by the Juflices of the Peace in Seffions to be applied in purfuance of the faid recited Act of the fourteenth Year of the Reign of Queen Elizabeth, for the Relief of Prifoners, and of the faid Act of the nineteenth Year of the Reign of King Charles the Second, for providing Materials for the fetting poor Prifoners on work, (hall be paid out of the Monies arifing by this Adt. XXIV. And be it further enadted by the Authority aforefaid, That if any Action or Suit (hall be commenced againft any Perfon or Perfons for any thing that fhall be done in purfuance or by the Au- thority of this prefent Act, in every fuch Cafe the Action or Suit mall be commenced within three Months next after the Fact committed, and not afterwards, and (hall be laid and brought in the refpec- tive County in which the Caufe of Action or Suit fhall arife, and not elfewhere ; and the Defendant or Defendants in fuch Action or Suit to be brought fhall and may plead the General Iffue, and give this Act and the Special Matter in Evidence at any Trial to be had thereupon, and that the fame was done in purfuance and by the Authority of this Act ; and if it fhall appear fo to be done, or that fuch Ac- tion or Actions (hall be brought after the Time before limited for bringing the fame as aforefaid, or fhall be brought in any other County or Place ; that then the Jury ihall find for the Defendant or Defend- ants ; and upon fuch Verdict, or if the Plaintiff or Plaintiffs fhall be nonfuited, or difcontinue his, her or their Actions or Suit, after the Defendant or Defendants hath or have appeared, or if upon Demurrer Judgment mall be given againft the Plaintiff or Plaintiffs, the Defendant or Defendants fhall and may recover Treble Cofts, and have the like Remedy for the fame, as any Defendant or Defendants hath or have in other Cafes by Law. CAP. XXX. An Ad for granting a Liberty to carry Sugars, of the Growth, Produce or Manufacture of any of his Majefty's Sugar Colonies in America, from the faid Colonies directly to Foreign Parts, in Ships built in Great Britain, and navigated according to Law. ' hJ H E R E A S by an A6t made in the T welfth Year of the Rei g n of the ]ate Kin g Charles the ' VV Second, intituled, An Aft for e?icouraging and increafing of Shipping and Navigation, and another ' Act made in the fifteenth Year of the faid King, intituled, An Aft for the Encouragement of Trade, and ' another Act made in the live and twentieth Year of the Reign of the faid King, mtituled, An Aft for ' the Encouragement of the Greenland and Eaftland Trade, and for the better fecuring the Plantation Trade; ' which Acts have been by fubfequent Acts fince continued, and are now in Force, all Sugars of the ' Growth or Production of the Englijl) Plantations in America, Afia or Africa, are obliged to be import-
- ed into England, Wales or Berxv ick upon Tweed, or to fome other of the Britijh Plantations mAmeritt,
' under fuch Securities and Penalties as other enumerated Goods 2nd Commodities of the Growth, »' Production or Manufacture of the faid Plantations, are fubjected to by the faid Acts, fome or one of ' them : And whereas his Majefty's_ Sugar Colonies in America are of great Importance to the Trade, ' Navigation and Strength of this Kingdom : And whereas the Planters of the faid Sugar Colonies are ' unable to improve or carry on the Sugar Trade on an equal Footing with Foreign Sugar Colonies, ' without fome Advantages and Relief be given them from Great Britain : And whereas it is reafonable 1 to expect, that not only the Produce of the faid Commodity in the faid Colonies, but alfo the Expor- ' t'ation thereof, would be greatly increased, for the mutual Benefit of this Kingdom and the faid Colo- ' n'es, if (notwithstanding the Laws relating to Navigation and Trade to and from the Plantations) Li- ' berty or Licence were granted for Ships built in and failing from Great Britain, and chiefly owned ' by the Subjects of his Majefty refidlng in Great Britain, to load Sugars in the faid Colonies, and to ' carry the fame directly to any Foreign Ports in Europe, firfc touching at fome Port or Ports in Gre, ' Britain (except where fuch Ship goes to the Southward of Cape Fmijhrrc) whereby the faid Sugars ' wiil arrive at fuch Ports fooner, with lefs Charge, and in better Condition for theConfumption there- ' of:' For this End, and to encourage his Majefty's Subjects in the Britijh Sugar Colonics in AmcfUA to improve and extend their Settlements there, and to prevent any Prejudice or Damage to this Nation, which might happen thereby from any Unlawful Commerce between 'the Plantations and any Foreign Countries, and to fecure the Navigation, Shipping, Inter.courfe and Dependence on Great Britain; May it therefore pleafe your moft Excellent Majefty that it .may be enacted; and be it enacted by the ■King's moft Excellent Majefty, by and with the Advice .and Confent of the Lords Spiritual and Tern- 8 poral,
