20 Geo. z. c.36.' Manner of enter- ing Linens for Exportation. Directions to the Officers of the and by fuch Ways, Means and Methods, and under fuch Penalties and Forfeitures, as the Duties now payable upon foreign Cambricks are to be raifed, collected, levied, and recovered. II. And be it further enacted by the Authority aforefaid, That out of the faid additional Duty upon fo- reign Cambricks, there fhall be given and paid, without any Fee, Reward, or Deduction whatfoever, s Bounty of one Penny, for every Yard of Britijh and Irijh Linens made of Hemp or Flax, of the Value 01 fix Pence per Yard, and not exceeding the Value of twelve Pence per Yard ; and of one Halfpenny for every Yard of fuch Britijh and Irijh Linens, under the Value of fix Pence per Yard ; which from and af- ter the twenty-fifth Day of March one thoufand feven hundred and forty-three ; and within the Term ol feven Years, to commence from the faid twenty-fifth Day of March, or at any Time thereafter, before the End of the then next Scflion of Parliament, fhall be exported out of Great Britain, to Africa, Ame- rica, or Portugal, or which fhall be exported to Spain, from and after the Time that it fhall be lawful to export fuch Linens to that Kingdom. III. Provided always, That the Exporter of fuch BritiJJj and Irijh Linens, fhall, in his Entry thereof exprefs the Quantity and Value ; and likewife indorfe on the Cocquet granted upon fuch Entry, the true Quantity and Value of the faid Linens intended to be fhipt ; and moreover fhall, before he receives any fuch Bounty, produce a Certificat? from the Searcher, or other proper Officer appointed to fee the fame fhipped, verifying the Shipping thereof; and fhall likewife give fufficient Security to the Collector or Cuftomer of the Port, in the Penalty of double the Value of the Goods intended to be exported, and one hundred Pounds, which Security they are hereby impowered to take in the Name, and to the Ufe of his Majefty, his Heir's and Succeflors, that fuch Linen fo fhipped, or intended to be fhipped, or any Part thereof, fhall not be relanded, or brought on Shore again in any Port or Part of Great Britain, Ireland, or the Ifle of Man ; and fhall alfo, before he receives any fuch Bounty, make Oath, or being a Quaker, a fo- lemn Affirmation (which Oath or Affirmation, the proper Officers of the Cuftoms have hereby Power to adminifter) of the refpective Values of fuch Linens, upon which the faid Bounties refpectively are granted, and that the fame were made in Great Britain or Ireland. IV. And to prevent Linens exceeding the Value of twelve Pence per Yard being exported for the fake of the faid Bounty, Be it further enacted by the Authority aforefaid, That the Collector and Comptroller, v^fraudul'nT or ot ^ er P ro P er Officers of the Cuftoms may open, view, and examine any or all fuch Linens as fhall be Entries. entered at the Value of twelve Pence per Yard, or under, and compare the fame with the Value and Price thereof fworn to or affirmed in the Entry and Endorfement on the Cocquet ; and if upon fuch View and Examination, it fhall appear that fuch Linen is of greater Value than twelve Pence per Yard, then, and in fuch Cafe, the Exporter or Proprietor fhall, on Demand made in Writing by the Cuftomer, or Collector and Comptroller of the Port where fuch Goods or Merchandizes are entred, deliver, or caufe to be deli- vered, all fuch Goods and Merchandizes into his Majefty's Warehoufe at the Port of Exportation, for the Ufe and Benefit of the Crown ; and upon fuch Delivery, the Cuftomer or Collector of fuch Port, with the Privity of the Comptroller, fhall, out of any Money in the Hands of fuch Cuftomer or Collector arifing by Cutoms, or other Duties belonging to the Crown, pay to fuch Exporter or Proprietor the Value of thirteen Pence per Yard, taking a Receipt for the fame, from fuch Exporter or Proprietor, in full Sa- tisfaction for the faid Goods, as if they had been regularly fold ; and the refpective Commiflioners of the Cuftoms fhall caufe the faid Goods to be fairly and publickly fold for the beft Advantage ; and out of the Produce thereof, the Money fo paid or advanced as aforefaid, fhall be repaid to fuch Cuftomer or Collec- tor, with the Privity of the Comptroller, to be replaced to fuch Funds, from whence the fame was bor- rowed ; and the Overplus, if any, fhall be paid into his Majefty's Exchequer towards the Sinking Fund, by the Title of The additional Duty on Cambricks granted by this Act. V. And in order to prevent Abufes by exporting Linens which fhall be under the Value of fix Pence .per Yard, when the.Merchant fhall in his Entry and Endorfement on his Cocquet exprefs, that the Va- lue thereof is fix Pence per Yard, or upwards, in order fraudulently to obtain a Bounty of one Penny, Farther Direc- inftead of a Halfpenny per Yard ; Be it further enacted by the Authority aforefaid, That it fhall and may tions to the Of- be lawful to and for any Searcher or other proper Officer, after the Entry of any of the faid Goods, and before or after the fliipping thereof, to open and ftrictly examine any Bail, Trufs, Cheft, or other Package, to fee if the Goods are right entered, and endorfed on the Cocquet; and if on fuch Examina- tion, the fame fhall be found to be right entered and endorfed, the Searcher fhall, at his own Charge, caufe the fame to be repacked, which Charge fhall be allowed to the faid Officer by the CommiJfioners of the Cuftoms, if they think it reafonable; but in cafe the Officer fhall on Examination find fuch Goods to be lefs in Quantity than fhall be expreffed in the Endorfement in the Merchants Entry or Cocquet, or under the Value of fix Pence per Yard, or that the Goods fhall be entered and indorfed under a wrong Denomination, whereby his Majefty would have been defrauded, all the Goods contained in all and every the Package or Packages endorfed on the faid Entry or Cocquet may be feized, and the fame fhall be forfeited and ioft, and the Owner or Merchant fhall lofe the Benefit of receiving the Bounty for fuch Goods. VI. And it is hereby further enafted by the Authority aforefaid, That if any Britijh or Irijh Linens for which fitch Bounty fhall have been given or claimed, fhall be relanded in Great Britain, Ireland, or the Ifle of Man, the fame fhall be forfeited, and every Perfon concerned in bringing back or relanding the fame, fhall forfeit twelve Pence for every Yard fo brought back or relanded. VII. Provided always, That nothing in this Act contained fhall extend, or be conftrued to ex- tend, to give any Bounty on any Linens that are ftriped or chequered, or mad; into Buckrums or Tilletings.
