CAP. I. An Act for granting an Aid to his Majefty by a Land Tax to be raifed in Great Britain, for the Service of the Year one thoufend feven hundred and forty-four. E X P. At 4s. in the Pound. CAP. II. An Act for continuing the Duties upon Malt, Mum, Cyder, and Perry, in that Part of Great Britain called England; and for granting to his Majefty certain Duties upon Malt, Mum, Cyder, and Perry, in that Part of Great Britain called Scotland, for the Service of the Year one thoufand feven hundred and forty-four. EXP. I. Provided always, and it is hereby enabled, That nothing in this Act contained fhall extend, or be Buyers of Cyder conftrued to extend, to charge any Perfon or Perfons with the Duty upon Cyder or Perry, fuch Perfon and Perry for or Perfons buying the fame for his or their private Ufe only, and not being a Dealer or Dealers in Cyder uf e ' r no'tu) be or Perry, or a Retailer or Retailers thereof. charged II. And be it further enacted by the Authority aforefaid, That every Perfon or Perfons whatfoever, who p er f ns felling fhall, after the twenty-fifth Day of March one thoufand feven hundred and forty-four, fell any Quantity lefs than 20 of Cyder or Perry, or either of them, in lefs Quantity than twenty Gallons at a Time, whether the fame Gallons, to be be made from Fruit of his, her, or their own Growth, or from bought Fruit, fhall be deemed and taken °«m«d R eE allers > to be a Dealer in Cyder and Perry, and a Retailer thereof, and fhall be fubjedt and liable to the Duty of four Shillings per Hogfhead, for fuch Quantity of Cyder and Perry fo fold, over and above all other Duties payable for Cyder and Perry fold by Retale ; and that every Dealer in, and Retailer of Cyder and Perry, and other Perfon and Perfons receiving into his, her or their Cuftody or Cuftodies, any Quantity of Cyder or Perry, or either of them, for Sale ; and every Perfon and Perfons who fhall buy any Fruit to make into Cyder and Perry, or either of them, for Sale, fhall make a true and particular Entry in Writing of the feveral and -refpe&ive Store-houfes, Rooms, Cellars, Vaults, and other Place or Places by him, her or them reflectively made ufe of, for the making or keeping of Cyder and Perry, or either of them, at the Office of Excife within the Compafs or Limits whereof fuch refpe&ive Storehoufes, Rooms, Cellars, Vaults, and other Place or Places fhall be fituated ; on Pain of forfeiting the Sum of fifty Pounds for every fuch Storehoufe, Room, Cellar, Vault, or other Place, which from and after the faid twenty-fifth Day of March one thoufand feven hundred and forty-four fhall be made ufe of by any fuch Dealer or Retailer, Receiver or Maker refpectively, without making fuch Entry thereof as aforefaid: And that allDuties, F'ines, Penalties, and Forfeitures by this Act impofed, fhall be fued for, levied, recovered, or mitigated by fuch Ways, Means, and Methods, as any Duty, Fine, Penalty, or Forfeiture, is or may be recovered or miti- fated by any Law or Laws of Excife, or by Action of Debt, Bill, Plaint, or Information, in any of his dajefty's Courts of Record at TVeJlminJler ; and that one Moiety of every fuch Fine, Penalty, or Forfei- ture, fhall be to his Majefty, his Heirs and Succeffors, and the other Moiety to him or them that fhall difcover, inform, or fue for the fame; and if any Perfon or Perfons fhall at any Time be fued for any Thing done by him or them in purfuance of this Aft, he and they fhall and may plead the General Iflue, and give this Act for his or their Defence ; and if upon the Trial a Verdict fhall pafs for the Defendant, or the Plaintiff be nonfuited, then fuch Defendant or Defendants fhall have Treble Colts to him or them awarded againft fuch Plaintiff or Plaintiffs. Thefe two Claufes have been continued in every fubfequent Aft. r CAP. III. An Aft to oblige Overfeers of the Poor to give publick Notice of Rates made for the Relief of the Poor, and to produce the fame. HEREAS great Inconveniences do often arife in Cities, Towns Corporate, Paiifhes, Town- fhips and Places, by reafon of the unlimited Power of the Churchwardens and Overfeers of the ' Poor, who frequently on frivolous Pretences, and for private Ends, make unjuft and illegal Rates in a ' fecret and clandeftine M a nner, contrary to the true Intent and Meaning of a Statute made in the forty and third Year of the Reign of Queen Elizabeth, intituled, An Aft for the Relief of the Poor ;' For 43 Eliz, c. zj Remedy whereof, and preventing, the like Abufes for the future, Be it enacted by the King's moft Excel- lent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, Vol. VI.
