XXX. An Aft for the more effectual preventing of the affixing of counterfeit Stamps to foreign or other Linens. WHEREAS certain Stamps are required by Law to be put upon Linens made in Scotland and For femur Pre. Ireland, the better to afcertain the Quality of fuch Manufactures : And whereas of late Years ■uifiom concerning there has been a Practice to counterfeit fuch Stamps, and affix, the fame to foreign Linens, in order to I :" c "' "f" " vend them as the Manufactures of Scotland and Ireland, to the grofs Deceit and Impofition of the ^w'h [ t" Buyers, and to the great Difcredit of the (aid Manufactures : And whereas there has alio been a Prac- 7 -- ■,;/;>",'.. „. tice, when Linens of the Manufacture of Ireland have been mildewed or foiled, to rebleach tnc faid Am.ft.%.c.%. ' Linens, and then to affix counterfeit Stamps ther;to, in order to vend them as Linens duly flam pi d : ; '■ 8. For Remedy whereof, Be it enacted by the King's moll Excellent Majefly, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament afTembled, and ^° ™' by the Authority of the fame, That if any Perfon or Perfons fhall, after the twenty-fourth Day of ft. " z . c .g,i6 June one thoufand feven hundred and forty-four, affix or caufe, or procure to be affixed any Stamp or & »i. 1 Geo. r. Stamps, in Imitation of the Stamp or Stamps put upon the Linens of the Manufacture of Scotland or c - 3 6, 3 G ">- »• Ireland, on any foreign Linens imported into this Kingdom, fuch Perfon or Perfons fo offending fhall c ' 1 ** "• for each and every fuch Offence, being convicted thereof in the Manner herein after mentioned, feve- penaky oVput-' rally forfeit the Sum of five Pounds for each Piece of Linen fo (lamped, or caufed or procured to be ting cpimterfcfo ftamped ; and if any Perfon or Perfons fhall, after th; faid twenty-fourth Day of "June, fell, expofe to Stamps on fo- Sale, or pack up for Sale, any foreign Linens, knowing them to be fo (lamped as aforefaid, as the Ma- rei e n Linen* ; nufadture of Scotland or Ireland, fuch Perfon and Perfons fo offending, and being thereof convicted in oJtjt'lfin^them the Manner herein after mentioned, fhall forfeit the faid Linens, and the Sum of five Pounds for each t0 Sale." 8 Piece thereof fo fold, expofed to Sale, or packed up for Sale as aforefaid; and in cafe any Perfon or Penalty on fixing Perfons fhall, after the twenty-fourth Day of June, affix any counterfeit Stamp or Stamps upon any counterfeit Linens of the Manufacture of Great Britain or Ireland, in order to vend the fame as Linens duly (lamped, Sumps on Bri- fuch Perfon or Perfons fo offending, and being convicted thereof in the Manner herein after mentioned, "f 11 orIri,h fhall forfeit the Sum of five Pounds for every Piece of Linen fo ftamped as aforefaid; and in cafe any Per- packine u or ■ fon or Perfons fhall, after the faid twenty-fourth Day of June, fell, expofe to Sale, or pack up for Sale, expofmg them t» any fuch Linens, knowing the fame to be fo ftamped as aforefaid, fuch Perfon or Perfons fo offending, Sale. and being thereof convicted in the Manner herein after mentioned, fhall forfeit the faid Linens, and the Sum of five Pounds, for each Piece thereof fo fold, expofed to Sale, or packed up for Sale as aforefaid. II. And be it further enacted by the Authority aforefaid, That it fhall and may be lawful for any one offenders to he or more Juflice or Juftices of the Peace for the County, Riding, Divifion, City, Town or Place where convicted on any Offence fhall be committed againft this Act, to convict the Party or Parties offending, upon the Sf* lr f h o: fe Oath of one or more credible Witnefs or Witneffes (which Oath fuch Juflice or Juftices are hereby im- a i^j;^ powered and required to adminifter) and upon fuch Conviction to grant a Warrant or Warrants under p ena ] t j cs ' t0 i, e his or their Hand and Seal, or Hands and Seals, to levy and recover the faid refpective Penalties and recovered" t> y Di- Forfeitures by Diflrefs and Sale of the Offender's Goods and Chattels, rendering the Overplus, if any ftrefs and Sale, there fhall be, after deducting the Charges of fuch Diflrefs and Sale, to the Owner or Owners thereof; and in cafe no Goods or Chattels of the Party or Parties fo offending can be found, or there fliall not be For want of Goods or Chattels fufficient to pay fuch Penalties and Forfeitures, any one or more of fuch Juftices of the 'j hflre .'?> oft-n- Peace fhall, upon Proof thereof made upon Oath (which Oath he and they is and are hereby impowered m^",^! er j£ and required to adminifter) before him or them, by the Perfon or Perfons who fhall have the Execution f onme nt.
