Ct'^S. 64.1 been paid on Account of the faid Sale, into the Receipt of his Majefty's Exchequer, which including the Sum fo paid on the twenty-t$fth Day of June one thoufand feven hundred and twenty, as one fifth Part of the faid Purchafe Money, amount together to the Sum of fifty-one thoufand nine hundred fc- venty-two Pounds five Shillings and ten Pence, and the Refidue or Surplus of the Purchafe Money, being five thoufand' one hundred and twenty-feven Pounds fourteen Shillings and two Pence, was re- tained by the faid Governor and Company, on Account of an Abatement and Allowance craved by them thereout, in rcfpe£t of feveral Over-valuations, which were made in the printed Rental or Par- ticular, by which the faid Eftate was purchafed : And whereas the faid Governor and Company being: indebted confiderably on their Bonds, did by Indentures of Leafe and Releafe, dated the feventeenth and eighteenth Days of January one thoufand feven hundred and thirty-one, convey the faid Eftate fo pur- chafed or contracted for by them as aforefaid, ■ unto certain Truftees therein named, in Truft to be fold for the Payment of fuch of the Bond Creditors as had accepted the faid Eftate as a Security ; and the faid Truftees were foon after put into PoffefTion of the faid Eftates : And whereas by a Decree of the Hight Court of Chancery, made on the twenty-fourth Day of Oflober one thoufand feven hundred and forty, in a Caufc wherein feveral of the Bond Creditors of the faid Company, claiming under the faid Truft, were Plaintiffs, and the (aid Governor and Company, and the faid Truftees under the laft Con- veyance were Defendants, it was ordered and decreed, that the faid Creditors were intitled to the Be- nefit of the faid Trufts, and that an Account fhould be taken of their Debts, and that the faid Eftate ftiould be fold for fatisfying the fame, fubject to the Demand of the Crown for what remained due of the Purchafe Money, and that the Money arifing by fuch Sale (after fetting apart thirty thoufand Pounds to anfwer the Demands of the Annuitants for Lives charged on the faid Company's Eftates in Scotland) fhould be applied in Satisfaction of what fhould appear to be really and bona fide due to fuch Bond Creditors of the faid Company, as were within the Terms and Conditions of the faid Truft, and the faid Truftees defiring to be difcharged of their Truft, it was ordered, . that they fhould be difcharged- accordingly, and that new Truftees fhould be appointed in their Stead : And whereas Sir Andrew Chad- wick Knight, Samuel Grove Clerk, and another Perfon fince deceafed, were in purfuance of the faid Order appointed Truftees, in the Room and Stead of the former Truftees fo difcharged by the faid Order, and the faid Sir Andrew Chadwick, and Samuel Grove, are now in the PoffefTion of, arid Receipt of the Rents and Profits of the faid Eftates, and. there is now due to the feveral Creditors of the faid Company, claiming under the" faid Truft the Sum of one hundred and twenty-one thoufand Pounds, and upwards : And whereas all , the Truftees of the. forfeited Eftates appointed by the faid Act of Par- liament of the fourth Year of his faid Majefty KingGEQRGE the Firft, except the faid Sir Thomas Rales Baronet, George Gregory, and Denis Bond, are dead : And whereas a confiderable Sum of Money hath accrued and become due for Intereft, as well of fuch Part of the faid Principal Sum of fiftyvfeven thoufand one hundred Pounds, fo contracted to be paid for the Purchafe of the Premifl.es, as was not paid into. the Exchequer within the Time ftipulated and appointed by the faid Contract, as of the faid Sum of five thoufand one hundred twenty-feven Pounds fourteen Shillings and two Pence, fo remain- ing unpaid, and retained by the Purchafers as aforefaid : And whereas the Creditors of the York Build- ings Company have propofed, and are willing to pay into the Receipt of his Majefty's Exchequer, the faid Sum of five thoufand one hundred' twenty-feven Pounds fourteen Shillings and two Pence, being the Remainder of the principal Money fo contracted to be paid for the Purchafe of the Eftate of the faid William, late Lord Widdrington, in the County of Northumberland, as aforefaid, and they having made their humble Petition and Application to Parliament, for an Allowance and Abatement in refpect of the feveral Over-charges and Over- valuations, which were made in the printed Rental or Particular, by which the faid Eftate was purchafed ; and for Relief in the PremifTes, the Commons of Great Bri- tain, in this prefent Parliament afTembled, have taken their Cafe into Confideration, and have thought it.juft and reafonable, that the faid Sum of five thoufand one hundred twenty-feven Pounds fourteen Shillings and two Pence, being the principal'Money remaining due for the Purchafe of the late Lord Widdrington 's Eftate, in the County of Northumberland, contracted for by the York Buildings Com- pany, fhould be accepted in full Difcharge of the Purchafe Money for that Eftate, and that the fur- viving Commiffioners and Truftees for the forfeited Eftates fhould be authorized and impowered to execute proper Conveyances of the faid Eftate to the Truftees for the Creditors of the faid Company, upon Payment of the faid Sum into his Majefty's Exchequer:' Wherefore we your Majefty's moft du- tiful and loyal Subjects, the Commons in Parliament afiembled, moft humbly befeech your Majefty, That it may be enacted, &c. " On Payment of 5,127 /. 14^. 2 d. into the Exchequer before June 24, 1745, and producing a Voucher " thereof, to the furviving Commifiioners of 4 Geo. 1. or their Heirs, they may convey the Eftate of the " late Lord Widdrington to Truftees for the Purpofes mentioned by Indenture, and Decree of Chancery." .
