And be it further enacted and declared by the Authority aforefaid, That the Collectors of the have 3d. in the aforefaid Rates and AfTefTments in England, Wales, and Berwick upon Tweed, hereby granted, for gathering the particular Sums charged upon the Parilh or Place for which they fhall be appointed Collectors by virtue of this Act, and for giving Receipts to the Perfori or Perfons of whom they receive the fame, fhall, upon Collection of the whole Sum appointed to be collected by them, and Payment thereof as is thereby before appointed, have and receive for their Pains in collecting and paying the Money three Pence in the Pound, which the faid Collectors are impowered to detain out of the laft Payment of the Monies of their feveral and refpective quarterly Payments; and the faid Receiver General, upoo the Receipt of the whole AfTeiT- ments of the County, Riding, City or Town, for which he is appointed Receiver General (in cafe he fhall have received the feveral Duplicates of each Parilh and Place therein, and that Duplicates mail be returned to the Office of his Majefty's Remembrancer of the Exchequer, as aforefaid, and not otherwife) fhall Commifficners allow and pay according to fuch Warrant as fhall be given in that Behalf by the faid CommifTioners, or SeeflSfoenci! an y. tw0 or more of th em > three Halfpence in the Pound, and no more, for the Commiffioners Clerks, for in'the Pound'. 1 their Pains in fair writing the Affeffments, Duplicates and Copies herein before diredted, and all Warrants, Orders and Inftruclions relating thereunto. And be it further enacted and declared, That if anyPerfon fhall refufe or neglect: to pay any Sum levy by p' ftref s> or Sums of Money, whereat he or fhe fhall be rated or aiTefTed in England, Wales, or Berwick upon Tweed, o'l^PaVnient! 11 ' 1 ^y this Act, upon Demand, by the faid Collector or Collectors of that Place, according to the Precepts or Eftreats to him or them delivered by the faid Commiffioners, that then, and in all and every fuch Cafe and Cafes, it fliall and may be lawful to and for the faid Collectors, or any of them, and they are hereby autho- rized and required to levy the Sum aiTefTed by Diftrefs and Sale of the Goods and Chattels of fuch Perfon fo neglecting or refufing to pay, ordiftrain upon the Mefliiages, Lands, Tenements and Premifles, fo charged Diftrefs to be w ith any fuch Sum or Sums of Money; and the Goods and Chattels then and there found, and the Diftrefs ihe t 'Owner' ySi ' t ^ 9 ta k en s to keep by the Space of four Days, at the Colts and Charges of the Owners; and if the faid Charge- then Owners do not pay the Sum or Sums of Money fo rated or affefTed within the faid Space of four Days, appraifed and then the faid Diftrefs to be appraifed by two or more of the Inhabitants where the fame fhall be taken, or ■ fold, and Over- other fufficient Perfons, and to be fold by the faid Collectors for Payment of the faid Money; and the Over- plus returned, p] us CO ming by fuch Sale (if any be) over and above the Tax and Charge of taking and keeping the faid Diftrefs, to be immediately returned to the Owners thereof; and moreover, that it fliall be lawful to break open in the Day-time any Houfe, and, upon Warrant under the Hands and Seals of any two or more of the faid Commiffioners, any Cheft, Trunk, Box, or other Thing, where any fuch Goods are, calling to . . their Affiftance the Conftables, Tythingmen or Headboroughs within the Counties, Ridings, Cities, Towns or Places where any Refufal or Neglect fliall be made; which faid Officers are hereby required to be aiding Commiffioneis and affifting in the Premifles, as they will anfwer the contrary at their Perils; and if any Queftion or Dif- ferewK^'boilt ei ^ ence ma 'l na PP en upon taking fuch Diftrefs, the fame fliall be determined and ended by the faid Com- Diftiefs. miffioners, or any two or more of them; and if any Perfon or Perfons afleffed by this Act in England, Wales, For want of Di- or Berwick upon Tweed, as aforefaid, fliall neglect or refufe to pay his, her or their Afleflment by the Space ftrefs, offender of ten Days after Demand as aforefaid, or convey any of his, her or their Goods, or other Perfonal Eftate, ted* fedTra" wriereD y the Sums of Money fo affefTed cannot be levied according to this Act; in every fuch Cafe, any PeeVor e pee P refs a of two or more °? the Commiffioners aforefaid, for any City, County or Place, are hereby authorized, by- Great Britain) Warrant under their Hands and Seals, to commit fuch Perfon or Perfons (except a Peer or Peerefs of Great Britain)
