Truth may be beft known, and to determine what Sum or Sums of Money the faid Collectors, or any of them, did receive or levy, or fraudulently convert to their own Ufe or Ufes as aforefaid ; and thereupon to andonEx.rn.ina- i]]' u e their Warrants and Orders, requiring all and every fuch Collector or Colleftors, their Heirs, Lxecu- their wYrra'its tors anJ Adminiftrators refpe&ively, in whofe Hands the faid Commiffionera, or the major Part of them, for paying fuch fhall find any fuch Money to be remaining, or who Hull be chargeable therewith refpeftively, to pay the Monies to his fame to his Majefty's Ufe, in manner following; (that is to fay) in cafe there be any Deficiency remaining MajcfiysUfe. upon any fuch Parifh or Townfhip, of the ^uota or Proportion charged thereupon to the Tax impofed by the Aft or Afts, whereby or by Colour whereof the Money found, as aforefaid, was collected or levied ; then every fuch Deficiency fhall be fatisfied, in the firft place, out of the Monies Co to be recovered, or the fame Monics,_ fo far as they will extend, {hall be applied for or towards the making good of every fuch Deficiency refpeclively ; and in all Cafes where there is no Deficiency upon any fuch Parifh or Townfhip, or there fhall be an Overplus more than fufficient todifcharge any fuch Deficiency, the faid Commiffioners, or the major Part of them, fhall by their faid Order require the faid Money fo found, or the Overplus thereof, to be paid by the laid refpeftive Collectors, their Heirs, Executors or Adminiftrators, to the Re- ceiver General, towards difcharging fo much of the Proportions to be charged on fuch Parifh or Townfhip by virtue of this prefent Aft. The Payments CXV. And it is hereby declared and enafted, That fuch Payments fo to be made in purfuance of the t^thVcommtf! faid Orders or Warrants of the faid Commiffioners, or the major Part of them, as aforefaid, fhall be good fione^s Wan-ant's, and fufficient Difcharges to the laid Colleftors, their Heirs, Executors and Adminiftrators refpeftively, &-c. And it is hereby declared and enafted by the Authority aforefaid, That if any fuch Collector as- paying, may be aforefaid, fhall negleft or refufe to pay any Sum.or Sums of Money according to fuch Order of the faid i™B (i f*j° d i and Commiffioners as aforefaid, within the Time or Times by fuch Order or Orders to be limited ; the faid feized and fold, Commiffioners for each Hundred, Parifh or Place, or any two or more of them, in their refpeftive Divi- fions or Diftrifts, are hereby authorized and impowered to imprifon the Perfon of every fuch Colleftor, till he makes Payment of the faid Money ; and to feize and fecure the Eftate as well Freehold as Copyhold, and all other Eftate, both Real and Perfonal, of fuch Colleftor, to him belonging, or which fhall defcend or come into the Hands or Pofleffion of his Heirs, Executors or Adminiftrators, wherefoever the fame can be difcovered or found ; and the faid Commiffioners, who fhall fo feize and fecure the Eftate of any fuch Colleftor or Colleftors, fhall be and are hereby impowered to appoint a Time for a General Meeting of the faid Commiffioners for fuch Hundred, Divifion, Parifh or Place, and to caufe publick Notice to be given of the Place where fuch Meeting fhall be appointed, fix Days at leafl before fuch Meeting; and the Commiffioners prefent at fuch Meeting, or the major Part of them (in cafe the Monies detained be not paid and fatisfied as it ought to be, according to the Direftions of this Act) fhall and are hereby impowered and required to fell and difpofe of all fuch Eitates, which fhall be for the Caufe aforefaid feized and fecured, or any Part thereof; and, out of the Monies arifing by fuch Sale, to fatisfy and pay (in manner prefcribed by this Aft) the Sum which fhall be detained in the Hands of fuch Colleftor or Colleftors, their Heirs, Exe- cutors and Adminiftrators refpeftively, with the Charges of recovering, raifing and paying the fame; and the Overplus (if any be) to be reftored to fuch Perfon as owned the faid Eftate before the Sale thereof; any former Aft or Afts of Parliament, or other Matter or Thing, to the contrary notwith- ■ itanding. ' CXVII. And whereas feveral Arrears of Land Taxes, granted by former Afts of Parliament, do flilli ' remain unfatisfied, which ought to have been levied, affeffed or re-affefled by the refpeftive Commiffioners ' in fuch Afts named or appointed, fome of which being fince deadj or removed to diltant Places ;' It is Arrears of former hereby declared and enacted by the Authority aforefaid, That the Commiffioners by this Aft named or ap- Land Taxes to be pointed, or fo many of them as are hereby impowered to caufe the Monies by this Aft granted to be affefled levied by the pre- or ra [f e j ? jfh^n anc j they are hereby impowered to caufe the Monies fo in Arrear upon the faid Land Taxes fioners 0mm ' " t0 ^ e affefled, re-afiefled, levied and anfwered, as fully and effectually as any Commiffioners appointed by former Afts might have done in that Behalf; and the faid Affeflbrs, Colleftors and Receivers, lhall refpec- tively aflefs, re-affefs, levy, receive and anfwer the feveral Arrears in fuch Manner, and under fuch Penal- ties, and by fuch Means, and as fully and effeftually, as in this Aft they are impowered and required, with refpeft to the feveral Sums by this Aft charged. NoReceiverGe- CXVIII. And whereas by virtue of feveral Afts of Parliament fpecially made, or to be made, for the ' better repairing of certain publick Roads, Turnpikes have been or may be fet up, and Tolls or Duties Tolls or Duties ' taken for repairing the faid Roads ;' It is hereby provided and declared by the Authority aforefaid, That onTurnpikesnot f ucn Tolls and Duties are not, and fhall not be liable to be rated or taxed towards the Aid granted by this chargeable by ^^ or towarc i s any Aid granted by any former Aft for a Land Tax ; and that the feveral Officers and merAa ny "' Perfons employed, or to be employed, in collecting fiich Tolls, and repairing fuch Roads, fhall not be liable '
