Interpretation

4.(1) In this Instrument—

"the 1967 Act" means the Road Traffic Regulation Act 1967 as amended by Part IX of the Transport Act 1968(a).[1].

"motorway" means any part of any special road, on and after such date as may be declared in accordance with section 13(5) of the 1967 Act to be the date on which it is open for use as a special road,—

(a) which (save as otherwise provided by or under regulations made under section 13 of the 1967 Act) can only be used by traffic of Classes I or II of the classes of traffic set out—

(i)as respects England and Wales, in Schedule 4 to the Highways Act 1959(b)[2] as amended by the Special Roads (Classes of of Traffic) Order 1961(c)[3] and the Special Roads (Classes of Traffic) (England and Wales) Order 1968(d)[4]; and

(ii)as respects Scotland, in Schedule 2 to the Special Roads Act 1949(e)[5] as amended by the Special Roads (Classes of Traffic) (Scotland) Order 1964(f)[6] and the Special Roads (Classes of Traffic) (Scotland) Order 1968(g)[7]; and

(b) which is or forms part of a route to which the Minister or the Secretary of State has allocated a route number which begins with the letter "M" or ends with the letter "(M)", or which is a slip road which leads to or from a road which is or forms part of such a route;

"on" in relation to a traffic sign stated to be situated or erected on a road or any part thereof, or required to be so situated or erected, means on or near that road or part thereof;

"road" means any length of road; and

"speed limit" means a maximum or minimum limit of speed on the driving of motor vehicles on a road—

(a) imposed by an order under section 12 (which relates to temporary restrictions for road works) of the 1967 Act;

(b) imposed by regulations under section 13 (which relates to traffic regulation on special roads) of the 1967 Act;

(c) arising by virtue of the road being restricted for the purposes of section 71 (which relates to the general speed limit for restricted roads) of the-1967 Act;

(d) imposed or deemed to have been imposed by an order under section 74 (which relates to speed limits on roads other than restricted roads) of the 1967 Act;

(e) imposed by an order under section 77 (which relates to temporary speed limits and their continuation) of the 1967 Act on a specified road; or

(f) imposed by or under any enactment contained in a local Act, 7

but does not include any maximum speed limit imposed on all roads other than special roads under section 77 of the 1967 Act or any other speed limit
