III Despite the Government’s concession that a private person analogy exists in this case, the parties disagree about pre cisely which Arizona tort law doctrine applies here. We re mand the case so that the lower courts can decide this matter in the first instance. The judgment of the Ninth Circuit is vacated, and the case is remanded for proceedings consistent with this opinion. It is so ordered.
