12 2 STA T .4 4 65PUBLIC LA W 11 0– 41 7—O CT. 14 , 200 8‘ ‘ §9317.Degr ee gr anti nga u t ho rit yf or A ir U ni v er s ity ‘ ‘ (a)AUTHORI T Y.—Except a s p rovid edi n sections 9314 and 931 5 o f t h is tit l e ,u nder re g ulations prescri b edb y the S ecretary of the Air F orce, the co m mander of the Air U niversity may, upon the recommendation of the faculty of the Air University components, confer appropriate degrees upon graduates w ho meet the degree re q uirements. ‘‘(b) L I M IT A TIO N .—A degree may not be conferred under this section unless— ‘‘(1) the Secretary of Education has recommended approval of the degree in accordance with the Federal P olicy G overning Granting of Academic D egrees by Federal Agencies

and ‘‘( 2 ) the Air University is accredited by the appropriate civilian academic accrediting agency or organi z ation to award the degree, as determined by the Secretary of Education. ‘‘(c) C ON G R ES SIONA LN OTI F I C ATION R E Q UIREMENTS.—(1) W hen see k ing to establish degree granting authority under this section, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and H ouse of Representatives— ‘‘(A) a copy of the self assessment questionnaire required by the Federal Policy Governing Granting of Academic Degrees by Federal Agencies, at the time the assessment is submitted to the Department of Education ’ s National Advisory Committee on I nstitutional Q uality and Integrity; and ‘‘( B ) the subsequent recommendations and rationale of the Secretary of Education regarding the establishment of the degree granting authority. ‘‘(2) Upon any modification or redesignation of existing degree granting authority, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and House of Rep - resentatives a report containing the rationale for the proposed modification or redesignation and any subsequent recommendation of the Secretary of Education on the proposed modification or redesignation. ‘‘(3) T he Secretary of Defense shall submit to the Committees on Armed Services of the Senate and House of Representatives a report containing an explanation of any action by the appropriate academic accrediting agency or organization not to accredit the Air University to award any new or existing degree.’’. (2) CLERICAL AMEN D MENT.—The table of sections at the beginning of chapter 9 0 1 of such title is amended by striking the item relating to section 931 7 and inserting the following new item

( j ) EFFECTI V E DATE.—The amendments made by this section shall apply to any degree granting authority established, modified, or redesignated on or after the date of enactment of this Act for an institution of professional military education referred to in such amendments. SEC.54 4. TUI TI ONF O RA TTEN D ANCE OF FEDERA L E MP LO Y EES AT T H E UNITED STATES AIR FORCE INSTITUTE OF TECH - NOLO G Y. Subsection (e) of section 9314 of title 10, United States Code, as amended by section 543(h), is further amended by adding at the end the following new paragraphs: As s e ss m e nt s .R e por ts.
