(b) TEMPORA R YW A IV ERO FR EIM BU R S EME NT OF COSTS OF AC TIVITIES FOR N ON G OVERNMENTA LP ERSONNEL. — (1) AUT H ORITY FOR TEMPORARY W AIVER.— I n fis c a ly ears 2 00 9 and 2010, the Secretary of D efense may, w ith the conc u r - rence of the Secretary of State, wai v e reimbursement otherwise re q uired under subsection (f) of section 1 84 of title 10, United States Code, of the costs of activities of Regional Centers under such section for p ersonnel of nongovernmental and inter- national organi z ations who participate in activities of the Regional Centers that enhance cooperation of nongovernmental organizations and international organizations with United States forces if the Secretary of Defense determines that attend- ance of such personnel without reimbursement is in the national security interests of the United States. (2) L IMITATION.—The amount of reimbursement that may be waived under paragraph (1) in any fiscal year may not e x ceed $ 1,000,000. ( 3 ) ANNUAL REPORT.—The Secretary of Defense shall include in the annual report under section 184(h) of title 10, United States Code, in 2010 and 2011 information on the attendance of personnel of nongovernmental and international organizations in activities of the Regional Centers during the preceding fiscal year for which a waiver of reimbursement was made under paragraph (1), including information on the costs incurred by the United States for the participation of personnel of each nongovernmental or international organiza- tion that so attended. SEC.942 . R ES T R I CTI ON ONO BL I GA TION O F F U N D S FOR UNITED STATES SOUT H ERN CO M MAND DE V ELO P MENT ASSIST - ANCE ACTIVITIES. (a) REPORT AN D CERTIFICATION RE Q UIRED.—Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a report describing the development assistance activities carried out by the United States Southern Command during fiscal year 2008 and planned for fiscal year 2009 and containing a certification by the Secretary that such development assistance activities— (1) will not adversely diminish the ability of the United States Southern Command or its components to carry out its combat or military missions

(2) do not divert resources from funded or unfunded requirements of the United States Southern Command in connection with the role of the Department of Defense under section 124 of title 10, United States Code, as the single lead agency of the F ederal G overnment for the detection and moni- toring of aerial and maritime transit of illegal drugs into the United States; (3) are not unnecessarily duplicative of activities already conducted or planned to be conducted by any other Federal department or agency during fiscal year 2009; and (4) are designed, planned, and conducted to complement j oint training and exercises, host-country capacity building, or similar activities directly connected to the responsibilities of the United States Southern Command. 10USC 1 84note.
