n - e xc ess pr oper ty o fmil itary d epartments and D efense Ag encies. ’ ’. SEC.2813 . MODIF IC AT IO N OF U TI L IT Y SYSTEM CON V EYANCE AUT H O R ITY. Section 26 8 8oftitle1 0 , U nited States Code, is amended— (1) by redesignating subsection ( j ) as subsection (k)

and (2) by inserting after subsection (i) the following new sub- section: ‘ ‘(j) CONSTR U CTION OF UTILIT YI NFRASTRUCTURE AFTER CON V EY- ANCE OF A UTILITY SYSTEM.—(1) Upon con v eyance of a utility system, the Secretary of a military department may convey addi- tional utility infrastructure under the jurisdiction of the Secretary on a military installation to a utility or entity to which a utility system for the installation has been conveyed under subsection (a) if the Secretary determines that— ‘‘(A) the additional utility infrastructure was constructed or installed after the date of the conveyance of the utility system; ‘‘( B ) the additional utility infrastructure cannot operate without being a part of the conveyed utility system; ‘‘(C) the additional utility infrastructure was planned and coordinated with the entity operating the conveyed utility system; and ‘‘(D) the military department receives as consideration an amount e q ual to the fair market value of the utility infrastruc- ture determined in the same manner as the consideration the Secretary could require under subsection (c) for a conveyance under subsection (a). ‘‘(2) The conveyance under this paragraph may consist of all right, title, and interest of the United States or such lesser estate as the Secretary considers appropriate to serve the interests of the United States. ’ ’. SEC. 281 4 . DEFENSE ACCESS ROADS. (a) BASIS FOR TRANS P ORTATION N EEDS ASSESSMENT.—Section 210(a) of title 2 3 , United States Code, is amended— (1) by striking ‘‘(a)’’ and inserting ‘‘(a)(1)’’; and (2) by adding at the end the following new paragraph: ‘‘(2) If it is determined that an action of the Department of Defense will cause a significant transportation impact to access to a military reservation, the Secretary of Defense shall conduct a transportation needs assessment to assess the magnitude of the improvement required to address the impact.’’. (b) R EPORT ON RECENTLY IDENTIFIED TRANSPORTATION IMPACTS.—Not later than April 1, 2009, the Secretary of Defense
