September 3,1935 . To refer the claim of the Menominee Tribe of Indians to the Court of Claims with [S . 3210 .1 the absolute right of appeal to the Supreme Court of the United States .

India ns . is hereby conferred on the Court of Claims to hear, determine, Jurisdiction to he ar adjudicate, and render final judgment on all legal or equitable claims claims of. o f what soever natur e whic h the Menomi nee Tr ibe of India ns may have against the United States, arising under or growing out of any treaties, agreements, or laws of Congress, or out of any malad- ministration or wrongful handling of any of the funds, land, tim- ber, or other property or business enterprises belonging to said tribe or held in trust for it by the United States, or otherwise ; including, but without limiting the generality of the foregoing, (1) a claim for damages for swamp lands which the United States allegedly pur- ported to convey to the Menominee Tribe of Indians by a treaty rat ified May 12 , 1854 (10 Stat . L . 1064), but which the United Vol. 10, p .1064 . Sta tes al legedl y did not c onvey becaus e of a lready havin g conv eyed the same to the State of Wisconsin (9 Stat. L. 519) ; (2) claims Vol.s, p. 510. for damages resulting from the improper or unlawful expenditures of tribal trust funds, including trust funds created by the Act of April 1, 1880, entitled "An Act to authorize the Secretary of the Interior to deposit certain funds in the United States Treasury in lieu of investment " (21 Stat. L. 70), and the Act of March 22, Vol.21. p.70- 1882, entitled "An Act authorizing the sale of certain logs cut by the Indians of the Menominee Reservation in Wisconsin " (22 Stat. Vol.22,p.30. L . 30), and the Act of June 12, 1890, entitled "An Act to authorize the sale of timber on certain lands reserved for the use of the Menominee Tribe of Indians, in the State of Wisconsin " (26 Stat. Vol- 26, p .14 6. L. 146), and the Act of March 28, 1908, entitled "An Act to author- ize the c utting of t imber, the m anufac ture a nd sal e of t imber, and the preservation of the forests on the Menominee Indian Reserva- tion in the State of Wisconsin" (35 Stat . L. 51), and the Act of Vol- 35,p .51 . February 12, 1929, entitled "An Act to authorize the payment of interest on certain funds held in trust by the United States and Indian Tribes " ( 45 Stat . L . 1164) ; ( 3) claims for damages allegedly Vol . 45, p. 1164. caused by the United States cutting timber on the Menominee Res- e rvatio n cont rary t o the terms and pr ovisio ns of the af oresai d Act of March 28, 1908 (35 Stat . L . 51) ; (4) claims for damages allegedly Vol-35,p .51. caused by maladministration on the part of the United States as res pects its ma nagem ent of the t imber and lu mber i ndustr ies of the Menominee Indian Tribe, in particular, its management of the Menominee Indian mills . SEC . 2 . The Menominee Tribe of Indians is hereby empowered Petition to be filed . to bring such suit, as party plaintiff, against the United States, as par ty def endant , by filing its p etitio n in t he Cou rt of Claims and serving a copy thereof on the Attorney General of the United States . Such petition shall set forth the facts on which the claim for recovery is based and shall be verified by the attorney or attorneys employed by said M enomin ee Tr ibe of India ns in accord ance w ith ex isting law to prosecute such claims which may be made upon information and
