SEC. 2. In the event the city of Newark shall not elect to acquire said property as provided in section 1 of this Act, then the Secre- tary of War is authorized to o ffer said prope rty at public sale to the highest responsible bidder on terms and conditions to be pre- scribed by him, which terms and conditions shall not be less favor- able to the United States than those prescribed in section 1 of this Act : Provided, That if the highest responsible bidder shall fail to enter into and consummate a contract of sale, the Secretary of War may award the contract to the next highest responsible bidder or, in his discretion, readvertise said property for sale in like manner . SEC . 3 . Any co ntract of sal e shal l be s ubject to the condi tions that if the purchaser shall fail to pay any installment of the purchase price and in terest, if any , as and when t he same are due , or shall fail to comply with the other terms and conditions of the sale, then the Secretar y of War may, at his election , declare such purchaser in default and reenter and repossess said property in the name of the United States and he may thereafter cause said property to be readvert ised and resold at public sal e in accordance with the pro- visions of this Act . SEC . 4 . During any interval of time that the property may be in the cust ody of the Secr etary of War, he may, in a ma nner that will best conse rve th e inte rests o f the United State s, lea se said prope rty, or, if unable to lease the same, on satisfactory terms, may maintain and oper ate the same, o r, in the disc retion of the P resident, the property may be transferred by Executive order to the Department of Commerce for administration under the provisions of the Mer- chant Marine Act of June 5, 1920, as amended . SEC. 5. All sums received as a result of the sale of said property, after deducting therefrom any costs of appraisal and other necessary expenses incident to sale, shall be deposited in the Treasury of the United States as miscellaneous receipts .
