A Non-Jew who Has a Window Open to a Valley or Enclosure |
אינו יהודי שיש לו חלון פתוח לבקעה או לקרפף |

Paragraph 1 - If a non-Jew lives in an alley and he has an window behind his house open to a valley or an enclosed area, even if [the window] is only four tefachim by four tefachim, he does not render the residents of the alley forbidden, even if he removes and brings in camels and carriages through the alley all day. This is because he likes what is behind only his house more, because there is open space there. It is just like someone who has an opening to an alley that he doesn't use; he does not render forbidden. This assumes that the valley or enclosed area is bigger than two seahs, but if it is only two seahs, it is small and he does not like it as much. If a Jew has an opening to an alley and an opening behind his house to an enclosed area and he forgets to make an eruv, if the enclosed area is bigger than two seahs he renders the others forbidden because he cannot use it, so he is not removed from the alley. However, if it is enclosed for dwelling, even if it is bigger than two seahs, he does not render forbidden because he can use it. There is one who says that, on the contrary, if it is enclosed for dwelling, even if it is two se'ahs he renders forbidden; because it is enclosed for dwelling, it is not open space and he does not like it, so he is not removed from the alley. |
סעיף א - אינו יהודי הדר במבוי ויש לו חלון אחורי ביתו פתוח לבקעה או לקרפף, אפלו אין בו אלא ארבעה טפחים על ארבעה טפחים אינו אוסר על בני מבוי אפלו מכניס ומוציא גמלים וקרונות דרך המבוי כל היום, שחפץ יותר באותו שפתוח לו מאחוריו לבדו שיש לו אויר, והוי פתחו למבוי כמו שאינו רגיל שאינו אוסר. והוא שיש בבקעה או בקרפף יותר מסאתים, אבל אם אין בו אלא סאתים, קטן הוא ולא ניחא ליה ביה. וישראל שיש לו פתח למבוי ופתח מאחוריו לקרפף, ושכח ולא ערב, אם הקרפף יותר מסאתים אוסר, לפי שאינו ראוי לו ואינו מסתלק מן המבוי, ואם הקף לדירה, אפלו יותר מסאתים אינו אוסר כיון שראוי לו. ויש מי שאומר דאדרבה אם הקף לדירה אפלו בית סאתים אוסר, שכיון שהקף לדירה אין בו אויר ואינו חפץ בו להסתלק בשבילו מן המבוי. |
