NUMBER 51

INCREASING FINES

    SECTION Ⅰ. All existing provisions of law and regulatory measures which fix or impose a monetary fine for the violation thereof, are hereby amended so that each monetary fine is increased five (5) times; provided, that this enactment shall not be applicable to offenses consummated prior to the effective date hereof.

    SECTION Ⅱ. Paragraph 2 of Ordinance Number 41, dated 10 January 1946, is amended to read as follows:
    "Each Special Judicial Officer shall have original jurisdiction of cases in which the punishment imposed shall not exceed confinement in al penal institution for a period of thirty (30) days or a fine of seven hundred and fifty yen (¥750), or both."

    SECTION Ⅲ. Paragraph 12 of Ordinance Number 41, dated 10 January 1946, is amended to read as follows:
    "In a case where a fine or net fine is pronounced, the accused shall deposit the amount immediately. if he does not do so, he shall be held in custody for a term calculated by converting yen twenty five (¥25) into one day and for this purpose any amount less than ten twenty five (¥25) shall be taken as one day."

    SECTION Ⅳ. Paragraph 14 of Ordinance Number 41, dated 10 January 1946, is amended to read as follows:
    "The number of days of custody mentioned in paragraph 11 shall accordingly be considered as days served. The number of days of custody mentioned in paragraph 12 shall accordingly be considered as yen paid on the basis of yen twenty five (¥25) for one day, toward the discharge of a fine or net fine."

    SECTION Ⅳ. This ordinance shall be effective on the tenth day after the date appearing hereon.
