IV. Provided always, That this Act, nor any Claufe thereof, fhall be extended to bind any Perfon to keep Milch Kine, nor yet to breed or rear up Calves, as afore is expreffed, for fuch Sheep or other Beafts as the fame Perfons fhall keep or feed, to the Intent only to be fpent in his or their Houfe or Houfes, without Fraud or Covin. (2) This Adt to endure only unto the End of feven Years next following the Feaft of the Purification of our Lady aforefaid, and from thence to the End of the Parliament then next fol- lowing. Made perpetual by 13 El. c. 25. CAP. IV. The Payment of the firft Fruits of Spiritual Livings to the Queen fhall ceafe. The yearly Tenths hereto- fore paid to the Queen by the Statute of 26 H. 8. c. 3. fhall be employed to other godly Ufes. Parfonagss impropriate, Tithes, Glebe Lands, and other Ecclefiaftieal Livings, renounced by the Queen. But this Aci fhall not extend to Tenths referved upon Letters Patents. Rep. 1 Eiiz. c. 4. CAP. V. The Statute of 22 H. 8. c. 12. and 3 rjf 4 Ed. 6. c. 16. concerning Beggars, Vagabonds and idle Perfons, fhali be put in Execution. Relief for the Aged and impotent Poor of every Parifh, fhall be gathered weekly of the charitable Devotion of the Inhabitants. A Remedy where a Parifh is not able to relieve the Poor therein, and where a Town furcharged with Poor ftandeth in or near two Counties : And where there be feveral Parifhes in a City, Borough or Town. A poor Man licenfed to beg, fhall wear a Badge on his Breaft and Back openly. EXP. CAP. VI. An AGt againft the exceffive Taking of the King and Queen's Majefties Purveyors. Purveyors taking con- trary to Order fhall be punifhed. Great Annoyance done by the King's Purveyors. No Commiilion fhall continue above fix Months. The County fhall be named where Things fhall be taken. The Pro-. portion and Number of Things taken. Blanks in Parchment for every County where any Thing fhall be provided. The Conftable's Name fubferibed. The Purveyor fhall make a Docket of all Things by him taken. Dockets fhall be delivered to the JufHces of Peace. Former Statutes provided for Purveyors fhall be obferved. Statutes provided for Purveyors fhall extend to their Deputies. The Purveyor's Commiffion fhall be written in Englijh. 11 H. 7. e. 13. Further Provi- sions relating hereto, 31 El. c. 12. In what Mannei Horfes fliall be fold in Fairs or Markets. The former Mif- ufe in Sale of ftolen Horfes. A Place fliall be appointed for a Horfe Fair, and alfo a Toll- Taker. "When, where and of whom, Toll for Horfes ihall be taken. A Note of all Horfes fold in a Fair or Market. CAP. VI I. An Aft againft the buying of ftolen Horfes. FOrafmuch as ftolen Horfes, Mares and Geldings, by Thieves and their Confederates, be for the moil: Parts fold, exchanged, given or put away in Houfes, Stables, Back-fides and other fecretand privy Places of Markets and Fairs, and the Toll alfo privily paid for the fame, whereby the true Owners thereof, being not able to t- y the Falfhood and Covin betwixt the Buyer and Seller of fuch Horfe, Mare or Gelding, is by the Common Law of this Realm without Remedy :' II. Be it therefore enacted by the Authority of this prefent Parliament, That the Owner, Governor, Ruler, Fermor, Steward, Bailiff, or Chief Keeper of every Fair and Market overt within this Realm, and other the Queen's Dominions, fhall before the Feaft of Eajier next, and fo yearly, appoint and limit out a certain and fpecial open Place within the Town, Place, Field or Circuit, where Horfes, Mares, Geldings and Colts have been and fhall be ufed to be fold in any Fair or Market overt; (2) in which faid certain and open Place, as is aforefaid, there fhall be, by the faid Ruler or Keeper of the faid Fair or Market, put in and appointed one fufRcient Perfon or more, to take Toll and keep the fame Place from Ten of the Clock before Neon until Sun-fet of every Day of the forefaid Fair and Market, upon Pain to lofe and for- feit for every Default forty Shillings: (3) And that every Toll-Gatherer, his Deputy or Deputies, fhall, during the Time of every the faid Fairs and Markets, take their due and lawful Tolls for every fuch Horfe, Mare, Gelding or Colt, at the faid open Place to he appointed as is aforefaid, and betwixt the Hours of Ten of the Clock in the Morning and Sun-fet of the fame Day, if it be tendred, and not at any other Time or Place ; (4) and fhall have prefently before him or them, at the taking of the fame Toll, the Parties to the Bargain, Exchange, Gift, Contract, or putting away of every fuch Hcrfe, Mare, Gelding or Colt; and alfo the fame Horfe, Mare, Gelding and Colt fo fold, exchanged or put away ; (5) and fliall then write or caufe to be written in a Book to be kept for. that Purpofe, the Names, Surnames, and Dwelling-places of all the faid Parties, and the Colour, with one fpecial Mark at the leaft, of every fuch Horfe, Mare, Gelding and Colt ; (6) in Pain to forfeit at and for every Default contrary to the Tenor thereof, forty Shillings. III. And the faid Toll-Gat '.erer or Keeper of the faid Book fhall within one Day next after every fuch Fair or Marker bring and deliver his faid Book to the Owner, Governor, Ruler, Steward, Bailiff or Chief Keeper of the faid Fair or Market, who fhall then caufe a Note to be made of the true Number of all Horfes, Mares, Geldings and Colts fold at the faid Market or Fair, and fhall there fubferibe his Name, or fet his Mark thereunto ; (2) upon Pain to him that fhall make Default therein, to lofe and forfeit for every De- fault forty Shillings, and alfo anfwer the Party grieved by reafon of the fame his Negligence in every Behalf. IV. And
