Provided always, That in cafe any fuch Contributors who have already depoftted with, Contributors not making or (hall hereafter pay to the faid Cafnier or Cafhiers, any Sum or Sums of Money at the Times and good their Payments in the Manner before mentioned, in Part of the Sum or Sums fo by them refpeftively fubfcribed to- within the Time limited, wards the (aid Sum of two millions and eight hundred thoufand Pounds, or their refpeftive Execu- ° lor ' elt l le e P L > ts s tors, Adminiftrators, Succeilbrs or Affigns, (hail not advance and pay to the faid Caihier or Cafhiers the Refidue of the Sum or Sums fo fubfcribed at the Times and in the Manner before mentioned ; then and in every fuch Cafe, fo much of the refpeftive Sum or Sums fo fubfcribed as fhall have been aftually paid in Part thereof to the faid Caihier or Cafhiers, (hall be forfeited for the Benefit of the Publick ; and all Right and Title to the faid Annuity after the Rate of four Pounds per and all Right to the faid Centum per Annum in refpeft thereof, (hall be extinguished ; any Thing in this Aft contained to the Annuities. contrary thereof in any wife notwithstanding. XLIII. And it is hereby enafted by the Authority aforefaid, That if at any Time or Times it Deficiencies of the Fund fhall happen that the Produce of the Fund by this Aft eftablifhed for Payment of the faid Annuities, eftabliihed' for Payment fhall not be fufficient to pay and difcharge the fame, and other-Charges directed to be paid at the ° f , the fa '^ An " ultles > to End of any or either of the refpeftive Half-yearly Days of Payment, at which the fame are hereby t ^ time'out'of theSink- directed to be paid; then and fo often, and in every fuch Cafe, fuch Deficiency or Deficiencies (hall ing Fund; and may be fupplied out of any of the Monies which at any Time or Times (hall be or remain in the Receipt of the Exchequer, of the Surplulies, ExcelTes, Overplus Monies, and other Revenues compofing the Fund commonly called The Sinking Fund, (except fuch Monies of the faid Sinking Fund as are appropriated to any particular Ufe or Ufes by any former Aft or Afts of Parliament in that Behalf) ; and fuch Monies of the faid Sinking Fund (hall and may be from time to time iffued and applied accordingly; and if at any Time or Times before any Monies of the faid Duties fhall be brought into the Exchequer as aforefaid, there fhall happen to be a want of Money for paying the faid Annuities, which (hall be aftually incurred and grown due at any of the Half-yearly Days of Payment before mentioned, that then and in every fuch Cafe, the Money fo wanted (hall and may be fupplied out of the Monies of the Sinking Fund (except as before excepted) and be jibbed accordingly. XLV. Provided always, and be it enafted by the Authority aforefaid, That whatever Monies Which are to be replaced. ■ fhall be iiTued out of the Sinking Fund, mall from time to time be replaced by and out of the firft out of the fii-ft Supplies. Supplies to be then after granted in Parliament. XLV1. Provided always, and be it enafted by the Authority aforefaid, That in cafe there (hall be Surplus Monies referved any Surplus or Remainder of the faid additional Impofitions, Rates and Duties upon Wines and fm the Difpofiaon of Vinegar, and of the faid Duties upon Cyder and Perry by this Aft granted and eftablifhed, as the Parl| ament, Fund for Payment of the faid Annuities, after the faid Annuities and Charges and all Arrears thereof are fatisfied, or Money fufficient (ball be referved for that Purpofe ; fuch Surplus or Remainder (hall from time to time be referved for the Difpofition of Parliament, and fhall not be iffued but by the Authority of Parliament, and as (hall be directed by future Act or Acts of Parliament; any Thing in any former or other Aft or Afts of Parliament to the contrary notvvithftanding.. XLV II.
