The Law of Two Balconies on Two Upper Chambers |

Paragraph 1 - If two balconies (meaning boards that extend at the edge of an upper chamber into the public domain, Rash"i) that extend from two upper chambers towards each other have a four [tefachim] wide board between them, it is considered an opening and they make one eruv. Rem"a: If the distance between them is not four [tefachim], even without the connecting board the rule is the same [such that they are considered connected] (HaMagid chapter 3). If they want to, they can make separate eruvs. However, if they are not opposite each other, with one being east and one west, they cannot make an eruv together. Similarly, if one is higher than the other it is not considered an opening. This refers to when they are further than three tefachim away from each other, but if they are within three tefachim of each other, whether laterally or vertically, it is still considered an opening. |
סעיף א - שתי גזוזטראות (פרוש, נסרים בולטים בשפת תקרת העליה לרשות הרבים. רש"י.) הבולטות משתי עליות זו כנגד זו, ונתן ביניהם נסר רחב ארבעה, הרי הוא כפתח ומערבין יחד. הגה: ואם אין המרחק שביניהם ארבעה, אפלו בלא נסר נמי דינא הכי (המגיד פרק ג'). ואם רצו, כל אחת מערבת לעצמה. אבל אם היו זו שלא כנגד זו, שאחת משוכה למזרח ואחת למערב, אינם יכולים לערב יחד. וכן אם היתה אחת גבוהה מחברתה לא חשיב פתח. והני מלי כשמרחקות זו מזו שלשה טפחים, אבל אם הם תוך שלשה זו לזו בין ברחוק בין גבה, חשיב שפיר כפתח. |
