Permitted Ways to Get Food from a Store on a Holiday |
באיזה אפן מתר לקח ביום טוב מן החנוני מיני מאכל |

Paragraph 1 - The laws of getting eggs, nuts, or food and drinks from a store on a holiday are the same as for Shabbat (as was explained above in chapter 323 paragraph 4). If [the storekeeper] is a non-Jew, it is forbidden to take things from him that come from the ground or need to be trapped, unless it is clear that they were not picked or trapped today. Similarly, one should not take eggs from him out of concern that they were laid today. However, something that is not attached to the ground, does not need to be trapped, and isn't born can be taken from him even if it was brought from outside of the techum. Similarly, flour that was grounded today in a city that has a majority of non-Jews can be taken from him because it was grounded for non-Jews. The same is true for taking bread from him that was baked today (or on the preceding Shabbat) (Beit Yosef). |
סעיף א - לומר לחנוני לתת לו ביצים או אגוזים או שאר מיני מאכל ומשתה, דינו יום טוב כמו בשבת (כמו שנתבאר לעיל סימן שכ"ג סעיף ד'). ואם הוא אינו יהודי, אסור לקח ממנו דבר שבמינו במחבר או שבמינו מחסר צידה, אלא אם כן נכר בהם שלא נלקטו ושלא נצודו היום, וכן לא יקח ממנו ביצים שמא נולדו היום, אבל דבר שאין בו משום מחבר ולא משום צידה ולא משום נולד מתר לקח ממנו אפלו הובא היום מחוץ לתחום, וכן קמח שנטחן היום בעיר שרבה אינם יהודים, מתר לקח ממנו דאדעתא דאינו יהודי טחני לה, והוא הדין לקח ממנו פת שאפה בו ביום, (וכן אם נאפה בשבת שלפניו) (בית יוסף). |

Paragraph 2 - If a Jew asks a non-Jew before the holiday, "Buy me birds tomorrow," he is not acting properly, but if he does this, it is forbidden to eat them on the holiday. This is only true when they are not flying birds. If this happens regularly, he is forbidden from eating them, because it is not considered ex post facto if it happens regularly. |
סעיף ב - ישראל שאמר לאינו יהודי מבעוד יום תקנה לי יונים למחר, לא יפה עושה, אבל אם עשה כבר, מתר לאכל מהם ביום טוב, והוא שלא יהיו מפריחין, אבל אם רגיל בכך, אסור לאכל מהם, דאין זה חשוב בדיעבד כיון שרגיל בכך. |

Paragraph 3 - If one tells his friend to fill a container with wine, the rule is the same on a holiday as it is on Shabbat. Rem"a: As was explained in chapter 323. It is also the rule that it is forbidden to do a lottery on a holiday, just like Shabbat as was explained above in chapter 322 paragrah 6. |

Paragraph 4 - It is forbidden to measure barley to feed one's animal. Rather, he should estimate and give. |
סעיף ד - לא ימד אדם שעורים לתן לפני בהמתו, אלא משער ונותן לה. |
